Yesterday we blogged about how the landowners’ lobby group, Scottish Land & Estates, had told its members it intended to write a letter of complaint to Environment Cab Sec Roseanna Cunningham about the “disproportionate and unnecessary” temporary ban on setting grouse moors alight during a time of national crisis (see here).

Can’t help but think they’ll get short shrift from the Cabinet Secretary.
The SLE folks appear to be intent on making fools of themselves. What is the point in complaining to the Cabinet Secretary about a quite legitimate legislative progress, the democratically achieved outcome of which strongly supported the line they had already taken on the muirburn issue. What do they hope to achieve? This is simply complaining for the sake of doing so.

Basically “voluntary restraint” meant carry on as before as far as the SLA were concerned. The reason SLA are screaming about this law is, it is far harder to disguise 5 hectares of new muirburn than it is to bury a poisoned or trapped Hen Harrier. It also shows tougher laws with the ability to enforce them do have an impact. So licencing the shoots with the heavy penalties for infringment (loss of shooting permits and gun licences, heavy fines for the estate not just the employee) should keep the pressure on.
SLE have a very real complaint. It is that, contrary to their wishes, the legislature has decided that a damaging activity should cease, rather than simply yet one more time be advised against. Having spent decades during which false promises sufficed – both for them and the legislators – this will have come as an astonishing breach of convention. So, much as I love Mr Carbo’s cartoon, it seems to me to be an open question what’s going on here. Baby doesn’t get baby’s way is clearly one interpretation. But another is that this is the endgame of a – real time – power struggle. Bring it on, I say.

Maybe the Scottish Government should have trusted Scottish Land and Estates to police themselves? Oops – tried that one and they demonstrated they could NOT be trusted!
